Based on provided pictures I would definitly say it does spawn on the ground.
Also based on the fact that developers haven't confirmed that tey have implemented a way to cros the water (they do desire to do so someday) I wouls say that there is verry litel chacne for oil to spawn on water athleast not until a way to traverse water gets implemented.

The source of the oil will be land oil spills.
